Employers needed a seat belt to keep pace with all of the changes in 2018.  At the state level, while employers were busy attempting to navigate NYS’s new paid family leave laws which took effect on January 1, Governor Cuomo signed into law new rules governing sexual harassment prevention in the workplace.  A few months later, the NYS Attorney General provided guidance to employers regarding the use of non-competes, and the NYS DOL rounded out the year by issuing revised proposed rules regarding on-call scheduling and call-in pay.  In the meantime, at the federal level, the United States Supreme Court upheld the use of mandatory arbitration agreements for employee class action claims, the DOL re-instituted its practice of issuing opinion letters, Congress quietly updated the required notices for background checks under the Fair Credit Reporting Act, the EEOC rescinded parts of its rules regarding wellness program incentives, and the NLRB continued to reverse course on almost every Obama-era initiative, including proposing favorable changes to the definition of joint employment.  Please join us as Kimberly Harding, attorney at Nixon Peabody, discusses these and other changes.
