NYS Employers – Prepare Now for Electronic Labor Law Posters

Employers in NYS have been required for many years to physically post various federal and state labor law posters to notify employees of their rights under certain laws. These posters must be displayed conspicuously in the workplace.

To help ensure employers are also sharing these posters with remote workers, the NYS Senate and Assembly passed S6805/A7595 and was subsequently signed into law December 16, 2022, which requires employers to:

  • Make these mandatory posters available online or via email as digital files
  • Notify employees of the availability of these documents online, such as through an employee handbook policy

This electronic posting requirement applies to all documents that are required to be posted in the workplace. To ensure compliance, employers should:

  • Check all state and federal laws and make sure all mandatory workplace posters have been posted in each of your physical locations.  Click here for a chart of state posters and links to download, and click here for federal posters. The US Department of Labor also has a poster advisor to help employers comply.
  • Create digital copies of these postings and upload them to your company intranet. If you do not have a company intranet, create an email and attach the digital file you’ve created with the various posters.
  • Notify all employees that the required documents are available electronically and where they can access them. Notify new hires during onboarding.
  • Additionally, employers will need to make sure to update the employee handbook and other resources with this information.
  • As posters are updated each year, employers should update the poster package as well and notify employees of the revised package.
