Daylight Saving Time and Work Hours
On Sunday, March 12, 2023, at 2 a.m., we will move clocks forward one hour to mark the beginning of Daylight Saving Time. Shift workers who are on duty at that time will work one hour less that day.
Employers are not required to pay their non-exempt employees for that missed time. However, employers may decide, as a matter of policy, to pay employees for the missed hour. If an employer adopts such a policy, under the Fair Labor Standards Act, that additional hour need not be included toward the calculation of hours worked to determine overtime since it is not compensation for hours actually worked during that work week. But an employer does have the option to include it in the overtime calculation if they wish.
